General Terms and Conditions of Sale – Disegnetti Depressetti LTD

Welcome to the Disegnetti Depressetti shop!

This document clearly and transparently explains how purchases work on our website and what your rights are as a customer. We invite you to read it carefully before placing an order: it is important, but we promise to keep it readable.

Disegnetti Depressetti LTD (hereinafter, the “Seller”) sells stationery, clothing, accessories, and creative products inspired by the Disegnetti Depressetti universe.

2. WHAT THESE TERMS GOVERN

These General Terms and Conditions of Sale govern:

• The sale of products through the Website,

• The rights and obligations of the customer,

• Delivery, return, and refund procedures,

• Everything needed to ensure a clear and secure relationship between us and you.

These Conditions apply to all orders placed through the Website by customers residing in Italy and the European Union, as well as customers in the United Kingdom, Switzerland, the United States, and other non-EU countries.

3. ELIGIBILITY TO PURCHASE

Purchases may only be made by individuals who:

• Are at least 18 years old,

• Are acting as consumers (i.e., for personal and non-professional purposes).

Orders placed by entities other than consumers may not be accepted.

4. PRODUCT DESCRIPTIONS

Every product is described as accurately as possible. The colors displayed on screen may vary slightly from the actual items due to lighting or the monitor used. Images are therefore for illustrative purposes only, but the essential features of the product are always detailed in the product sheet.

5. AVAILABILITY

We aim to keep stock availability updated in real time. However, if two people purchase the last item simultaneously, a product may become out of stock after the order is placed. In this case, you will receive an email notification and a full refund or, if you prefer, you can replace it with another item by informing us.

6. PRICES AND CURRENCY

All prices are listed in Euros (€) and include Italian VAT, where applicable. For orders from non-EU countries (such as the UK, Switzerland, and the US), the displayed price does not include customs duties or local taxes, which remain the customer's responsibility. Prices may change over time, but the valid price is always the one indicated at the time the order is placed.

7. PAYMENT METHODS

Payments are processed securely via Shopify; therefore, we do not store or see your payment details.

We accept credit/debit cards, Apple Pay, Google Pay, Shop Pay, and Satispay. Payment is due at the time the order is placed. Payment details are handled securely by Shopify Payments: the Seller never stores or accesses your bank details.

8. CONCLUSION OF THE CONTRACT

The sales contract is considered concluded when you receive an order confirmation email. If payment is unsuccessful, the order will not be processed. You will receive an email with all the details: purchased products, total price, shipping method, delivery estimates, and a tracking link.

8-bis. HOW TO COMPLETE AN ORDER (CHECKOUT PROCESS)

To complete an order, the customer must follow the Website's guided checkout process, which includes:

• a) Selecting the products;

• b) Entering shipping and billing details;

• c) Viewing the order summary with total price, shipping costs, and any return exclusions;

• d) Choosing a payment method;

• e) Final confirmation by clicking the "Complete Order" button, which also signifies acceptance of the "Terms and Conditions of Sale" and acknowledgment of the "Privacy Policy".

Before final confirmation, the customer can correct any data entry errors using the edit functions available on the various screens. The contract is concluded when the customer receives the order confirmation email pursuant to Art. 51, paragraph 7 of the Italian Consumer Code.

9. SHIPPING AND DELIVERY

Orders are processed on average within 1–4 business days (excluding weekends and public holidays). During high-volume periods (new collection drops, holidays), shipping may take longer. All packages are sent via tracked courier.

Indicative delivery times:

• Italy: 1–4 business days

• EU: 4–7 business days

• UK and Switzerland: 5–10 business days

• Rest of the world: 7–15 business days

Once tracking indicates "Delivered", responsibility transfers to the customer. Any customs duties or import fees are the responsibility of the recipient.

10. PRODUCTS EXCLUDED FROM RETURNS

On the website, you will find a specific group of products clearly marked for which we do not offer refunds or returns:

"Final Sale": These are seasonal items (e.g., planners, calendars, or other limited edition collections) that, once the sales period ends, may be offered at discounted prices. If purchased at a discounted price, returns will not be accepted under any circumstances.

11. RIGHT OF WITHDRAWAL

For all other purchased items, the customer has the right to withdraw from the contract within 14 days of receipt, without providing any reason. To exercise your right of withdrawal, simply contact us using the contact form on the website, specifying your order number, full name, and the product you wish to return.

You will receive an email with instructions and the exact return address. Return shipping costs are the responsibility of the customer. Refunds will be processed within 14 days of receiving the return, following an inspection of the product's condition, using the same payment method used for the original purchase.

12. LEGAL GUARANTEE OF CONFORMITY

All products sold are covered by the legal guarantee of conformity provided for by Articles 128–135 of the Italian Consumer Code. In the event of manufacturing defects or non-conformity, the customer must report it within two months of discovery by contacting us via the website form.

14. LIMITATION OF LIABILITY

Disegnetti Depressetti LTD is not liable for delays or service disruptions attributable to the courier, force majeure events, or improper use of the products. Under no circumstances shall the Seller's liability exceed the total value of the order.

15. INTELLECTUAL PROPERTY

All content on the Website (text, graphics, illustrations, trademarks, images, and design) is protected by copyright and registered trademark laws. Copying, modifying, or using such content without prior written permission is strictly prohibited.

16. PRIVACY AND DATA PROTECTION

Personal data is processed in compliance with Regulation (EU) 2016/679 (GDPR) and applicable laws. For detailed information, please consult our Privacy Policy.

17. GOVERNING LAW AND JURISDICTION

These Conditions are governed by Italian law. Any dispute relating to the interpretation or execution of the contract shall be submitted to the exclusive jurisdiction of the court where the consumer resides or is domiciled.

For customers residing outside the European Union, any dispute shall be submitted exclusively to the Court of Milan (Italy), without prejudice to any mandatory rights provided by the laws of the consumer's country of residence.

18. AMENDMENTS AND UPDATES

Disegnetti Depressetti LTD reserves the right to amend these Conditions at any time for legal or operational reasons. New versions will be published on the Website and will become effective as of the date stated at the top. We encourage you to review them periodically to stay informed.
